I have had the pleasure of working with Richard Strauss, of MediateOne, LLC, in the mediation of long term care cases. I defend long term care facilities and find his approach unique and helpful. Mr. Strauss has an extensive background in long term care, which is very beneficial for mediations. We all speak the same language. He can also bring to bear his understanding of how long term care facilities work, which I have not found in other mediators, and I have been in this line of work for 20 years.
Mr. Strauss conducts mediations in a unique manner. He is extraordinarily prepared on mediation day. He has reviewed and outlined the party submissions and, in caucus, recites to us the strengths and weaknesses of our cases, all coming from the perspective of a person with an extensive background in long term care work. This workup is very helpful, especially with parties who have unrealistic expectations. His presentation lays the groundwork for the negotiations that follow. During negotiations, Mr. Strauss provides helpful insights on how positions taken, talking points and messages or numbers can be received. There is no indication of bias, but a well-reasoned perspective on the facts.
For every case in which Mr. Strauss has served as a mediator for my clients, they have resolved. My clients have been quite pleased with the fact that their cases were resolved and how they were resolved. As an added bonus, his fees are lower than any I have seen in my 28 years as a litigator.
